Although I am not an attorney, I handle the intake for every single RN license defense case that comes in and I work with our Chief Legal Counsel to assign those cases to the attorneys most familiar with the specific issue at hand. Because I handle phone calls from 100s of nurses a year and I actually listen to their issues, I am likely the most informed person in California with regards to the devastating results of Board of Nursing license accusations against nurses. Most of our cases are a result of first time DUI’s, many are gross negligence accusations and a number of them are similar to Amanda’s: a complaint for acting outside the scope of one’s practice. While outrageous and seemingly unjust, Amanda’s situation is not unique. I have stacks and stacks of files in my office with Accusations from the California BRN which include horribly damning language against the nurse, much of which, according to the nurse, is stretched, fabricated, embellished or just downright wrong. These accusations are not sent to me by the client. They don’t have to be subpoenaed. They aren’t sent to our lawyers because we are the named counsel of record, no. They are public record easily accessible on the BRN’s website for everyone including my grandma and 11 year old son to read. Keep in mind, at this stage they are still only ACCUSATIONS. Nothing has been proven, but regardless, the accusation with its condemning statements is there for all to see. What about being innocent until proven guilty? Is this a fair process? Or is this abuse? Boards of Nursing are necessary to protect the public from dangerous nurses. Their premise for existing is a noble one. We’ve all heard the horror stories: nurses stealing patient’s medication to the detriment of the patient, abusive nurses who continue practicing after harming their patients, people posing as nurse practitioners and practicing without so much as nurse assistant certificate. Nursing Boards are under the umbrella of state departments’ of consumer affairs and just like you would want your car mechanic flagged for sabotaging your transmission so he could make money fixing it, you want your health care providers held responsible for putting patients at risk. Amanda was accused of making mistakes that could have potentially led to patient harm, and she was reported to the Board. As the protector of the public, it was the Board’s responsibility and its duty to investigate the complaint against Amanda. They have paid investigators either on staff or contracted staff who investigate these complaints. These investigators are former public safety officers, DEA agents and district attorney investigators. Basically they know what they are doing and they know how to find evidence. Their job is made so much easier by the fact that damning evidence against an RN is so easy to come by: the complainant (usually the hospital) has all the records, charts, witnesses, etc. All the nurse has is her word. If anyone reviews a nurse’s performance, somewhere along the line they will find some frivolous procedural error, a charting mistake, a med discrepancy; busy humans under stress will eventually make a mistake. This is where the Board should have used its discretion to drop the entire thing against Amanda, but they didn’t. They found something they could hang on to and they dug in deep. This is what is happening to Amanda and tragically, what happens to thousands of other nurses. If someone is getting thrown under the proverbial bus, it is almost always the nurse. Once the investigator finds a “mistake” or is able to substantiate the complaint (and they always do), the Board of Nursing will file a formal complaint or accusation against the nurse. This is what goes public. This is what ruins the nurse’s life. Now herein lies the question with regards to Amanda and other nurses’ in her position: should the accusation be made public record before anything is proven? The accusation can have a detrimental effect on a nurse’s career, regardless of whether or not the complaint is true. She can be terminated if she is an “at will” employee, simply because the employer doesn’t want to deal with it. She can be shunned by her colleagues and co-workers for untrue statements in a complaint. It can ruin her life- even if it is all a lie. But can’t the same be said for the “alleged” criminal who is arrested for grand theft, booked into jail, whose reputation and family and job are ruined and his picture and broadcast across the evening news, but later found innocent and all charges dropped? Isn’t the Board simply following the same path as the justice system? Maybe at the beginning, but that is where the similarities end, at least in California. Where the evening news might cover the story that the theft suspect was exonerated, the nurse will get no such statement; the accusation will just be pulled and her license never disciplined. Had the theft suspect been required to go to trial, he would have been judged by a fair and impartial jury of his peers. The nurse gets judged by a self righteous Board of other nurses, none of whom have ever been disciplined. And the most glaring difference is even if the theft suspect had been found guilty and put in prison he wouldn’t have had to reimburse the court for the police officer’s time arresting him, the clerk’s time to process him, the jail’s time for holding him, the investigators time for investigating him, the DA’s time for prosecuting him and the judge’s time for imposing the sentence. The nurse has to pay all of those costs back to the Board. THAT is unjust. If there is anything to be outraged by in Amanda’s case, it isn’t so much that a physician threw her under the gurney to save his own scrubs or that the hospital took his side. It isn’t that the accusation with a bunch of alleged lies is public record for all to see. The thing to be outraged about is the fact that state Boards of Registered Nursing are not playing by the same rules as everyone else. They lack a reasonable due process. They are too powerful with very little oversight. There are too few checks and balances. The appeal process is skewed and too expensive to exercise. In California, they are borderline omnipotent and in my opinion, they have a bloated god-complex. The system is made even more repulsive by the fact that for every accusation that ends in a “discipline,” the nurse has to pay the Board, often tens of thousands in “reimbursement for reasonable costs”. That smells like blood money to me. So what is the recourse for Amanda and the thousands of nurses like her who’ve been enmeshed in the Board of Nursing’s cruel system? It is sadly very little, unless they have $40,000.00 for a writ of mandate and then additional funds for attorney’s fees to go to court over the matter. It could also help if they happen to be cozy with the governor. The only entities in California that can overturn a Board of Nursing decision are the Governor or Superior Court. Of course most nurses don’t have the ability to fork over $75,000.00 or $100k and their ties to the Governor are nil, so they just accept the Board’s discipline, which is usually probation and are grateful that they didn’t get their licenses revoked. The only way to change this is to write letters to the Governor or the head of your state’s department of consumer affairs. Seek the help of a lawyer as early as possible so that you don’t get taken advantage of and be careful in disclosing anything to the Board itself. I have more on that for a later piece. It is one thing to label you a zealot, it is another thing to fire you, blacklist you and destroy your career by going after your nursing license.
